Resolute Forest Products to proceed with lawsuit against Greenpeace after court setback
OAKLAND, CA, Oct. 17, 2017 (RISI) -After Greenpeace announced the racketeering lawsuit against it filed by Resolute Forest Products was dismissed, Resolute said it would proceed with the case.
District Court for the Northern District of California judge Jon S. Tigar dismissed all claims, Greenpeace said, including claims under the Racketeer Influenced and Corrupt Organizations (RICO) act ruling the group was exercising freedom of speech rights.
The judge said Resolute could try to meet his objections by rewriting its lawsuit, the San Francisco Chronicle reported.
"The Court dismissed the complaint for failure to allege certain elements of our claims with sufficient detail, and it provided Resolute with leave to correct those purported deficiencies in an amendment,” Resolute Forest Products’ counsel said. “We will correct those purported deficiencies in an amendment, and proceed with the case."
